Yume Hana School' Terms and Conditions General Provisions

Article 1 - Terms and Conditions and Scope of Application

  1. The terms ‘Yume Hana’, ‘us’ and ‘we’ refer to the owner of the membership website ‘Yume Hana School’. The terms ‘our service’ and ‘the service’ refer to our membership website. These Terms and Conditions will apply to the use of all services provided through our website including all web content.
  2. These Terms and Conditions consist of the following:
    ‘Yume Hana School’ General Provisions
    ‘Yume Hana School’ Forum Service Regulations
    ‘Yume Hana School’ Learning Questio Service Regulations
  3. The terms ‘you’ and ‘the user’ refer to all registered members. By using our service, you signify that you have read, understood and agree to be bound by these Terms and Conditions. If you disagree with any of these terms, please do not use our website.
  4. We may modify these terms including regulations at any time without notice and any changes will immediately become valid. You may withdraw your membership in compliance with article 9, paragraph 1 if you disagree with any changes.

Article 2 - Service Overview

  1. This is a members-only service for registered users of the ‘Yume Hana School’ website.
  2. Our service is provided to participants in our correspondence courses and the purposes of our service are the following:
    To support learning
    To provide learning information
    To promote exchange between participants
    Note that our service is not available to unregistered users.

We determine your web content and services based on your participant information. The provided contents and services will depend on your course and time of commencement.


  1. Administration of our service is performed by staff at the ‘Yume Hana School' Administration Office’. Web Content managers, selected by the Administration Office, provide web content and services.
  2. Individual contracts between users and the Administration Office related to the use of our service including Questions and Answers are considered to be part of our services, and come under these terms.
  3. We do not charge for our web services.

Article 3 - User’s System Environment

  1. Set-up and maintenance of all equipment such as electronic devices and software required to access our service is at your expense. You must operate this equipment appropriately, and we will not take any responsibility for the set-up or support of such equipment. We have no role in your selection of Internet Service Provider or the method by which you connect to the Internet.
  2. This service has been confirmed to be compatible with computers using a Japanese operating system. We do not guarantee access from mobile phones or other Internet capable devices.

Article 4 - Membership Registration

  1. You need to be registered to use our service. People registering, hereafter referred to as ‘you’, must provide true and accurate information about themselves in the registration form.
  2. You need to provide your customer number, phone number and E-mail address in the registration process. Your phone number must match any you provided previously and must be up-to-date.
  3. Once you have completed the registration process, you will become an official user and will then be able to use our service. We will send you a confirmation E-mail to inform that you have completed registration.
  4. We may reject your registration in the following cases:
    If your registration has been cancelled previously by violating our Terms and Conditions.
    If we regard you as an unsuitable member.
    We also have the right to cancel your registration if we discover any grounds for cancellation, as specified in paragraph 2, Article 9 of the General Provisions or in the Forum Service Regulations or Learning Question Regulations.
  5. You are not able to register if you are under the age of 18.

Article 5 - Membership Cancellation

  1. We will immediately cancel your membership based on our terms if you request cancellation.
  2. You will be charged until the end of the month in which you made a request for cancellation. If you have ongoing costs in the next month or later, you will be refunded based on Article 5, Paragraph 3 . However, we will collect a one month fee in the case of cancellation during the provisional membership period.
  3. If you have a 3 month or 6 month contract and you cancel before your course is completed, we will recalculate your monthly fee as 2,000 yen. However, we shall not collect more than you have already paid.

Article 6 - Customer ID and Password

  1. You need a customer ID and password to use our service. You must use the password provided by us via E-mail.
  2. Maintaining the secrecy of your password is your responsibility. We shall not be liable for damages incurred through leakage or unauthorized use of your password regardless of fault.
  3. You are fully responsible for all activities that occur under your login.
  4. You must not transfer your customer ID and password to a third-party and you must not let others use your customer ID and password.

Article 7 - Conditions of Release

You shall not commit any of the acts listed below while using our service. If you perform or are likely to perform one of these acts, we may take measures such as providing E-mail, phone or written warnings, limiting the use of our service or membership cancellation.

  1. Transfer or lease your right to use our service to a third party.
  2. Divulge communication secrets or breach privacy or portrait rights of other users, other organizations or our company.
  3. Slander, libel or discriminate against other users, other organizations or our company.
  4. Make obscene, abusive, libellous, insulting or racist comments, or perform any actions that may threaten public order or cause psychological harm.
  5. Infringe on copyright, trademark, and intellectual property rights of others, other organizations or our company.
  6. Infringe on the rights and interests of other users, other organizations or our company including libel affecting their credibility or honour.
  7. Replicate or modify images or software used by our service.
  8. Misappropriate, tamper with or remove infomation of other users, other organizations or our company.
  9. Continue to use our service inappropriately despite prior warnings.
  10. Perform any act in violation of the Terms and Conditions and Regulations.
  11. Perform any illegal act.
  12. Make unauthorized use of the customer number, E-mail address or the password of other users, including impersonation of other users.
  13. Perform other acts we judge to be prejudicial to our service or other users.
  14. Perform other acts we judge to be inappropriate.

Article 8 - Copyright

  1. Any copyright and intellectual property rights relating to the documents, image and audio data or software in our service belong to our company or the owner of the data. However, if there are other specific provisions in the other Yume Hana regulations as detailed below, such provisions shall prevail.
  2. You shall not modify, duplicate, distribute or disclose our copyright products in whole or in part, even if you obtain a copy of these products while using our service. However, if there are other specific provisions in the other Yume Hana regulations as detailed below, such provisions shall prevail.

Article 10 - Membership Termination and Restriction of Usage

  1. You can cancel your memberships online using our cancellation service. You can rejoin using the online procedure unless your membership was terminated due to one of the conditions listed in Article 4, Paragraph 4.
  2. If you fail to comply with our regulations (see Article 6), we reserve the right to cancel your registration or restrict your access to our service. In this case, we may claim any damages caused by you.

Article 11 - Our responsibilities

  1. We shall maintain our service facilities to ensure reliable operation. If there is a problem with our facilities, we will repair it immediately.
  2. We will aim to provide you with accurate and useful information about the use of our service. Your use of this information is entirely at your own risk.

Article 12 - Service Disruption

1. We may disrupt part or the entirety of our service in the event of a problem with security, general operation, our telecommunications network or our network service provider, or for service maintenance.

Article 13 - User Notification

  1. We shall notify the user of the any of following situations:
    Introduction of new services and functions or any change in our services or functions.
    Termination or disruption of a specific service.
    Any situation as described in Article 11.
    However, this may not be possible in the case of an emergency.
  2. We may contact individual members for reporting purposes, to make requests or to inform of warnings related to our service.
  3. We will contact you via telephone, post, E-mail or via our website. If contacted by E-mail, any notification is considered complete when the E-mail has arrived at your server.
  4. If you did not provide correct contact information or, due to customer fault, any notification does not reach you, we consider that the notification has arrived when it should have normally done so.

Article 14 - Exemptions

  1. We take no responsibility for the unavailability of our service in the case of natural disasters, unavoidable accidents or due to any other cause described in these Terms and Conditions.
  2. We assume no responsibility for any damage resulting from the use of information provided by us. If we are found to be liable for some reason, we take no responsibility for any indirect damage resulting from this information.
  3. We assume no responsibility for damages incurred by you resulting from changes in or termination of our service, excluding cases covered in the preceding paragraphs 1 and 2, unless we are found guilty of malice or gross negligence.
  4. We have no control over the information you transmit or receive. It is not our responsibility if you lose or delete information due to equipment failure or other events as determined in these Terms and Conditions. Therefore, we advice you to make backup copies of all records.
  5. We assume no responsibility for damage caused by duplication or modification of our software, images or files or through use of software other than that distributed or recommended by our service.
  6.  If you file a lawsuit or have a dispute with other users or a third-party related to our service, you must resolve this at your own risk and expense. You must exempt us from any claim.

Article 15 - Jurisdiction Agreement

All disputes arising between you and our company shall be submitted to the exclusive jurisdiction of the Tokyo District Court in the first instance.

 

Article 16 - Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan.

Supplementary provisions

 These Terms and Conditions will be valid from April 1st, 2013.

 

 

“Yume Hana School” Forum Service Regulations

The terms ‘Yume Hana’,  ‘us’ and ‘we’ refer to the owner of the membership website ‘Yume Hana School’. The terms ‘our service’ and ‘the service’ refer to the ‘Yume Hana School' Forum service’. These regulations will apply to the use of our service. The term ‘you’ refers to the user of our Forum service. By using our service, you signify that you have read, understood and agree to be bound by these regulations.

 These regulations form part of the “Yume Hana School” General Provisions as determined earlier. In addition to these regulations, the General Provisions will also apply to the use of our forum service.

Article 1 – Service Overview

  1. This is a members-only service for registered users of the ‘Yume Hana School’ website.
  2. The objective of our forum is to provide communication opportunities to participants of our correspondence courses to discuss common themes related to the courses. This does not form part of our teaching service, as the user is the main provider of information on the forum.
  3. You may only use forums, related to courses you are registered in. We determine which forums you can access based on your course registration.
  4. Administration of our forum service is performed by staff at the ‘Yume Hana School' Administration Office’
  5.  Individual contacts between users and the Administration Office related to the use of our forum service including the Questions and Answers section are considered to form part of our services and come under these regulations.

Article 2 - Prohibited Matter

The following actions are prohibited on our forum service.

  1. Commit an act in violation of any laws or regulations. Commit an act that constitutes a crime or may lead to a crime.
  2. Make obscene, abusive, libellous, insulting or racist expressions, or perform any actions that may threaten public order or psychological harm to others.
  3. Slander or libel other users, other organizations or our company.
  4. Infringe on a third-party’s privacy by displaying their personal information or information that is suggestive of their personal information.
  5. Use, collect or disclose a third-party’s personal information on the forum such as their ID number, user name or E-mail address without their permission.
  6. Post false or unfounded rumours leading to damage to other users.
  7. Disclose answers or assist in answering course questions to help other users. Commit an act that potentially leads to the creation of their answer.
  8. Commit an act that disturbs the atmosphere of our forums such as posting irrelevant items or repeating the same post.
  9. Use someone else’s name, hence disguising yourself as a different person.
  10. Post for the purpose of advertisement, trade or business such as a pyramid scheme, or make any posts that may be construed as such.
  11. Post information relating to an election campaign, political activity, religious activity and the like, or make any posts that may be construed as such.
  12. Post information that causes confusion or disturbs our service, such as chain mail, spam, junk E-mails or phishing E-mails.
  13. Commit an act that affects or may affect our website, site user’s computers or telecommunication equipment such as transmitting harmful software.
  14. Tamper with information that is used on our forum service.
  15. Sell or use information obtained from our service for commercial purposes.
  16. Infringe on the rights of other users, other organizations or our company including patent laws, copyright, trademark laws, property rights, trade secrets, intellectual property rights and portrait rights.
  17. Perform other acts we judge to be inappropriate.

Article 3 - Prohibition and Restriction of usage

1. We may prohibit or restrict your usage of our service if we judge this to be inappropriate.

Article 4 - Privacy Policy

1. Your personal information such as your name, phone number, address, membership number and E-mail address is fully protected and is not accessible on the forums. You will be given a user ID for identification on the service.

Article 5 - Copyright 

  1. You may infringe the copyright of a third-party if you post their product or work on our service without permission. If there is a complaint, you must resolve this at your own risk and expense.
  2. Copyright relating to the content, images and software on the forums belongs to the author of the post and our company except in the cases described in Article 5 paragraph 1. You may infringe this copyright if you copy, distribute, translate or modify any posts in whole or in part. Any such cases will be managed as described in Article 5, Paragraph 1.
  3. We may modify, duplicate, reproduce, distribute or disclose any post on our forum for service provision or to use as introductory material.

Article 6 - Our rights

  1. It is our right to delete the entirety or part of any post that violates the General Provisions or Regulations without the permission of the author.
  2. It is our right to delete any post that has been displayed for a certain period or any post that exceeds a certain length without the permission of the author. We will determine the maximum length and time period and may change these on occasion without notice.
  3. We reserve the right to send all users E-mail notifications or to post online information related to our service.
  4. We may disrupt or terminate our services in whole or in part if necessary.

Article 7 - Exemptions

  1. We will not view posts to our forum before they are displayed. You are fully responsible for all disclosures made on our forums regardless if deleted or not. We assume no responsibility for any damage caused by forum posts.
  2. If you have disputes with other users or with a third-party caused by our service, you must resolve them at your own risk and expense. You must exempt us from any claim.
  3. Any posts are created for your personal use for which you are fully responsible. We assume no guarantee for the authenticity, legality, safety, suitability or validity of any posting.
  4. We assume no responsibility for users in the case of changes to, termination of or disruption of our service without notice due to unavoidable circumstances.

Supplementary provisions

These regulations will be valid from December 1, 2011.

The terms ‘Yume-Hana’, ‘us’ and ‘we’ refer to the owner of the membership website ‘Yume Hana School’. The terms ‘our service’ and ‘the E-mail service’ refer to the ‘Yume Hana School' Learning Question service’. These regulations will apply to the use of our service. The term ‘you’ refers to the user of our E-mail service. By using our service, you signify that you have read, understood and agree to be bound by these regulations.

These regulations form part of the “Yume Hana School” General Provisions as described earlier. In addition to these regulations, the General Provisions will also apply to the use of the E-mail service.

Article 1 – Service Overview

1. This is a members-only E-mail service for registered users of the ‘Yume Hana School’ website. Any query you make regarding your course will be forwarded to the relevant person selected by our company and you will obtain an answer from that person.

Article 2 - Conditions

  1. This E-mail service is provided to participants of specific correspondence courses enrolled after a particular date as determined by our company.
  2. If you withdraw from a purchased correspondence course before commencement, you will not be eligible for the E-mail service.

Article 3 - Service Period

  1. The E-mail service is effective until the expiry date of each course as determined by us.
  2. If you cancel your course prior to completion, your eligibility for the E-mail service will end the day after cancellation.

Article 4 - Scope of E-mail questions

1. The content of any E-mail question must be related to the course or textbook. We may not answer questions unrelated to the course.

Article 5 - Your responsibilities

  1. You must ask a clear and specific question to be able to receive a relevant answer.
  2. Important points regarding questions:
    (1) The title of the question should be descriptive.
    (2) The content of the question should clearly correspond to the title.
    (3) File attachments are allowed only if relevant to the question. Unrelated file attachments should be avoided.

Article 6 – E-mail Limitations

  1. Only one question is allowed per E-mail. One E-mail is allowed per month.
  2. The maximum number of characters in the E-mail is 2000.
  3. Available file types are ‘jpeg, jpg, gif, png, pdf and txt’. Each file size should not exceed 2Mb.
  4. The maximum number of file attachments is 4 per E-mail.

Article 7 – Answering your E-mail questions

  1. Answers of E-mail questions will also be in E-mail format.
  2. In exceptional cases, answers may be sent by post, e.g. if they contain a diagram or if E-mail is unavailable. If you wish to receive your answer by post, please use the printable question form and send it to us by post.

Article 8 - Copyright

1. Copyright relating to the answers, images, audio or any other data in our E-mail service belong to our company. Reproducing, distributing, translating or modifying the entirety or part of our E-mail contents will be subject to copyright infringement laws.

Article 9 - Exemptions

  1. We assume no responsibility for the delay or inability to answer your questions in the case of system difficulty. However, we will endeavour to reply as promptly as possible.
  2. If our services are unavailable for a period due to system difficulties, we will not extend your course duration.

Supplementary provisions

These regulations will be valid from April 1st, 2013.
